It is necessary to write a claim in which you insist on termination of the sales contract. It is important to note that the requirement can be written only one of two things: either a refund, or an exchange for another model, i.e. you cannot write "return or exchange". In addition, you should think about whether it is worth borrowing anything else from this store, after they sold you a faulty phone.

It will not be superfluous to use the help of a lawyer or employees of the consumer protection bureau to draw up a claim.
