You recently bought or received a new cell phone as a gift. But the most unpleasant thing happened - the phone broke down or does not work in full range of its functions. Try to fix the situation. This is not difficult if the phone really has flaws or a factory defect.

Instructions

Step 1

If the store refuses to take back the phone or exchange it for a similar one, be aware that you are deliberately misled. Mobile phones are subject to exchange and return within the manufacturer's warranty period.

Step 2

Communicate with the seller in writing. Write a claim. Make it out in duplicate. The claim must be signed by the seller. Make sure to sign both copies. In addition, it must be stamped, signed and received for consideration. Write the reason for returning the phone. Attach copies of your receipt and warranty card. Be clear about what you expect your grievance to be. Do you want to get your money back or exchange your phone? Think it over in advance. In any case, write the phrase in the claim: "I refuse any repair and restoration work."

Step 3

After your claim is signed, the seller is obliged to conduct an examination of the goods within 10 days. All expenses for the examination are borne by the store if the declared defects are confirmed. Declare your presence at the procedure. Keep the phone with you until the examination. If the process is delayed, you should know that every extra day of examination is estimated at 1% of the cost of the phone.

Step 4

After the examination, the seller is obliged to return the money to you or exchange the phone for a new one. If you did not indicate in the claim that you refuse repair and restoration work, then the phone must be repaired. At the time of its holding, the seller is obliged to provide you with a replacement device with the same set of functions as the one sent for repair. The maximum restoration work can last no more than 45 days. If after the expiration of the term you still have not received your device back, demand a refund or an exchange of the phone. After receiving the phone, ask for a mark on the repair and extension of the warranty for the appropriate period.

Step 5

If a cell phone was purchased on credit, among other things, contact the bank with an application to terminate the loan agreement.

Step 6

If all of the above does not lead to the desired result, go to court. Collect as much evidence as possible that your rights have been violated. Demand not only a refund for the phone, but also the payment of a penalty and compensation for moral damage. A lawyer will increase your chances of winning.
